Very strong slap on the wrist from the National Appeal Committee after the mess in Burgos-Ordizia: “Terribly disproportionate”

He National Appeal Committee of the Royal Spanish Rugby Federation has estimated the club’s appeal Recoletas Rugby Burgos and has annulled the sanction that kept him from the semifinals of the Men’s Honor Divisionso he will play this Sunday against Alcobendas just as planned.

The resolution, signed this Thursday, May 21, revokes the agreement of the National Sports Discipline Committee that had declared the loss of the quarterfinal match against the Ordizia for improper alignment, understanding that the Burgos team did not comply with the minimum number of category “A” players required by federation regulations, and definitively archives the disciplinary procedure.

The case revolved around the player Pablo Rascónwhose category initially appeared as “C” in the system due to a documentary problem derived from a random control carried out by the Federation.

However, the Appeal Committee It is considered proven that the player “was, is and will be category A” and emphasizes that he met all the material requirements required to compete in that condition.

In a particularly forceful resolution, Appeal maintains that there was no improper alignment “in a material sense” and defends that the objective of the regulations is to protect the cleanliness of the competition, not to sanction administrative or formal errors that do not alter the sporting balance.

The federative body also criticizes the attempt to modify the sporting result due to a “mere correctable formal non-compliance” and adds that this possibility would be “terribly disproportionate.”

Furthermore, it vindicates the “pro competition” principle, according to which the result obtained on the field of play must prevail unless there is a serious and clearly proven infraction.
